Willpath provides an online service for collecting estate-planning instructions for Queensland residents, which are reviewed by a Queensland solicitor before draft documents are released.

Instructions, not executed documents

Everything you complete online is a set of instructions. The drafts you receive are not valid legal documents until you print them and sign them in wet ink, witnessed as the Succession Act 1981 (Qld) and the Powers of Attorney Act 1998 (Qld) require.

Fixed fee

The fixed fee covers preparation of the drafts from your instructions and solicitor review, including any rounds of requested changes. You save a card when you submit; it is charged the agreed fee only when a solicitor approves your documents (no pre-authorisation or hold). If the matter is not accepted, your card is never charged. Complex matters (for example blended families, business interests, trusts, overseas assets or a beneficiary with a disability) may need separate advice, which will be quoted before any further work.

Solicitor-client relationship

Submitting this form does not create a solicitor-client relationship until a Willpath solicitor accepts the matter on review. If the matter is not accepted, your card is not charged.

Your responsibilities

You must give complete and accurate information, read the drafts carefully, and arrange signing and witnessing correctly. Tell us if anything is wrong before you sign.

Offer of a costs agreement

Offer to enter into a costs agreement. This is an offer by the law practice providing the Willpath service to enter into a costs agreement with you under section 322 of the Legal Profession Act 2007 (Qld). You may accept this offer in writing or by conduct. Clicking “Submit instructions and save card” is the conduct that accepts this offer.

  1. Services: preparation of draft estate-planning documents from your online instructions, and review and approval of those drafts by a Queensland solicitor (including any rounds of changes the solicitor asks for). Advice on matters outside your instructions (for example testamentary trusts, business structures or overseas assets) is not included and will be quoted separately before any work is done.
  2. Fixed price: the fixed price shown at checkout (Will $149, EPOA $99, AHD $79, or the estate bundle $199 — or $99 with a current promo code) in total, including GST. There are no other fees, disbursements or charges for the services, and no card surcharge.
  3. When you pay: your card is saved securely with Stripe now, but nothing is charged or held today. Your card is charged the fixed price only after a solicitor has reviewed and approved your documents and our invoice has been issued to you. If the solicitor asks for changes, there is no charge until the final approval. If your matter is not accepted, your card is not charged.
  4. Who invoices you: Willpath (Canaipa Law Group Pty Ltd, ACN 689 618 326) invoices you for the fixed price and receives your payment. Willpath pays the reviewing law practice, Canaipa Law, a fee for each approved file out of the price you pay.
  5. Electronic bills: you consent to receiving our invoice, bill, receipts and notices electronically at the email address you have given.
  6. Your rights: you have the right to request an itemised bill, to apply for a costs assessment, and to apply to set aside this costs agreement, within the time limits in the Legal Profession Act 2007 (Qld). Nothing in this agreement excludes those rights.
